Legal Information & Policies

Last updated: April 2026. These policies apply to all services provided by Deck Builder Christchurch across Christchurch, Canterbury, and the wider South Island of New Zealand.


1. Terms of Service

1.1 Agreement

By engaging Deck Builder Christchurch for any deck design, installation, repair, or maintenance service, you agree to the following terms and conditions. These terms form the basis of our working relationship and apply to all quotes, contracts, and completed work.

1.2 Quotes & Pricing

All quotes provided by Deck Builder Christchurch are valid for 30 days from the date of issue unless otherwise stated in writing. Quotes are based on information provided at the time of assessment. If site conditions, scope, or specifications change after a quote has been issued, pricing may be revised accordingly with your prior written approval.

1.3 Deposits & Payment

A deposit of up to 30% of the total project value may be required before work commences, particularly for custom builds requiring pre-ordered materials. The remaining balance is due upon practical completion of the work. Payment is accepted by bank transfer, credit card, or by arrangement. Overdue accounts may incur interest at a rate of 2% per month.

1.4 Project Variations

Any changes to the agreed scope of work requested by the client after commencement will be treated as a variation. Variations will be priced and documented in writing before proceeding. Deck Builder Christchurch reserves the right to adjust the project timeline due to variations.

1.5 Access & Site Conditions

The client is responsible for ensuring safe and reasonable access to the work site. Any hazards, underground services, or structural issues not disclosed prior to commencement that affect the project may result in additional costs and/or delays. Deck Builder Christchurch will not be liable for damage caused by pre-existing undisclosed conditions.

1.6 Cancellation

Cancellations made after a deposit has been paid and materials have been ordered may result in forfeiture of some or all of the deposit to cover material and labour costs incurred. We will always work with clients reasonably to minimise cancellation costs.


2. Privacy Policy

2.1 Information We Collect

Deck Builder Christchurch collects personal information to provide and improve our services. This may include your name, address, phone number, email address, and property details when you request a quote, contact us via our website, or engage us for work.

2.2 How We Use Your Information

Your information is used solely to:

  • Provide quotes, schedule work, and fulfil service contracts
  • Communicate with you about your project
  • Send relevant updates or promotions (you can opt out at any time)
  • Meet our obligations under New Zealand law

2.3 Privacy Act 2020

Deck Builder Christchurch complies with the Privacy Act 2020 (NZ). You have the right to access and correct any personal information we hold about you. To make a request, contact us at info@deckbuilderchristchurch.nz. We will respond within 20 working days as required by law.

2.4 Data Storage & Security

Your information is stored securely and is not sold or shared with third parties, except where required to deliver our services (e.g. material suppliers, subcontractors) or where required by law. We take reasonable steps to protect your data from unauthorised access, loss, or disclosure.

2.5 Cookies

Our website may use cookies to improve your browsing experience and gather anonymised analytics data. You can disable cookies in your browser settings at any time without affecting your ability to use our site.


3. Consumer Guarantees Act 1993

As a consumer in New Zealand, you have rights under the Consumer Guarantees Act 1993 (CGA). All services provided by Deck Builder Christchurch are guaranteed to be carried out with reasonable care and skill, completed within a reasonable time, and fit for the particular purpose communicated to us. If a service does not meet these guarantees, we will remedy the issue at no extra cost to you.

The CGA also guarantees that materials supplied by us will be of acceptable quality, match their description, and be fit for purpose. These rights cannot be contracted out of in consumer transactions.


4. Workmanship Warranty

Deck Builder Christchurch provides a 12-month workmanship warranty on all completed deck installations. This warranty covers defects in workmanship and installation errors. It does not cover:

  • Normal wear and tear
  • Damage caused by misuse, neglect, or modification by others
  • Weathering, fading, or natural material movement
  • Damage caused by events outside our control (e.g. earthquakes, flooding)

Manufacturer warranties on timber, composite, and hardware products are passed through to the client. Please refer to individual product documentation for warranty terms.


5. Health & Safety

Deck Builder Christchurch operates in accordance with the Health and Safety at Work Act 2015 (HSWA). We maintain a safe working environment on all job sites. Clients are asked not to enter active work areas without prior arrangement. If you become aware of any health and safety concern on your property during our works, please notify us immediately.

All our tradespeople hold current industry safety cards and are trained in safe work practices relevant to deck construction and timber installation.


6. Building Consent

Certain deck structures in Christchurch and Canterbury require building consent under the Building Act 2004 and the New Zealand Building Code. Deck Builder Christchurch will advise you at the quoting stage whether consent is required for your specific project. Where consent is required, it is the property owner’s responsibility to obtain it unless otherwise agreed in writing. We are happy to assist with documentation and council submissions.


7. Disputes

We aim to resolve any issues quickly and fairly. If you have a concern about our work or services, please contact us in the first instance at info@deckbuilderchristchurch.nz. If a dispute cannot be resolved directly, it may be referred to the Disputes Tribunal or the appropriate professional body under New Zealand law. Deck Builder Christchurch accepts the jurisdiction of New Zealand courts.


8. Limitation of Liability

To the extent permitted by New Zealand law (including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986), Deck Builder Christchurch’s liability is limited to the cost of re-supplying the relevant services. We are not liable for indirect, consequential, or incidental losses arising from our services.
